This page is for injury firms licensed in Florida. It covers the Florida rules that shape a car accident claim, what your intake team should screen for, and how our leads work. For how these rules compare across states, see the car accident leads by state hub.

Car crashes in Florida

Florida recorded 3,138 motor vehicle crash deaths in 2024, according to the Insurance Institute for Highway Safety's state-by-state Fatality Facts, based on the federal Fatality Analysis Reporting System (FARS). Deaths are only the most severe outcome; far more crashes cause injuries.

Florida rules that shape a car accident claim

Fault and insurance system

Florida is a no-fault state. Under Florida Statutes section 627.736, personal injury protection (PIP) pays up to $10,000 in medical and disability benefits, regardless of fault. Medical benefits apply only if the injured person receives initial services and care within 14 days after the accident, and reimbursement is limited to $2,500 if a provider determines there was no emergency medical condition.

Comparative fault rule

Florida uses modified comparative negligence. Florida Statutes section 768.81 reduces damages by the claimant's share of fault, and under subsection (6) a party found greater than 50 percent at fault for their own harm may not recover any damages.

Deadline to file an injury lawsuit

Florida Statutes section 95.11(5)(a) sets two years for an action founded on negligence.

The 14-day treatment rule

For intake, the PIP 14-day rule is the date to catch. If a caller hasn't seen a doctor since the crash, find out how many days have passed. A caller who was treated within 14 days has a different PIP picture than one who wasn't.

General information, not legal advice. Confirm current rules with the statute or your counsel.

What this means for Florida intake

  • Ask when they first got medical care after the crash, and where. Record the number of days since the accident.
  • Ask whether a provider said it was an emergency medical condition, if they know.
  • Get a clear account of fault. A caller found more than 50 percent at fault can't recover under section 768.81(6).
  • Ask whether they've already talked to or signed with another lawyer.

Speed matters more than any script. For call openings and follow-up, see our speed-to-lead intake scripts.

What every Florida car accident lead includes

The injured person fills in our form themselves. Each lead includes:

  • Accident type
  • Date of the accident
  • Location (state and ZIP)
  • Injury status
  • Medical treatment so far
  • Whether they already have an attorney
  • An SMS-verified phone number
  • A TrustedForm certificate

Leads that don't match your filters aren't sent. The TrustedForm certificate records the form session and the consent to be contacted, and the SMS check confirms the phone number. Our TrustedForm and lead verification guide explains how to read both.

How it works for Florida firms

  1. Book a call. Tell us you're licensed in Florida, plus any other states, the accident types you take, your intake hours and where leads should go.
  2. Set your Florida screening and place a first paid order. We agree your filters with you, using questions like the ones above.
  3. We run MVA campaigns nationwide. A lead reaches you only when the accident happened in a state you've chosen and the lead passes your filters.
  4. Leads arrive live in your CRM by webhook, LeadDocket, Litify or GoHighLevel, or by email or SMS alert. See lead routing and CRM delivery.

We don't publish lead volume or ad figures for any single state. The full process is on how it works, and the service is on our MVA leads page.

Does Florida's 14-day rule matter for car accident leads?
