Car crashes in Pennsylvania

Pennsylvania recorded 1,127 motor vehicle crash deaths in 2024, according to the Insurance Institute for Highway Safety's state-by-state Fatality Facts, based on the federal Fatality Analysis Reporting System (FARS). Deaths are only the most severe outcome; far more crashes cause injuries.

Pennsylvania rules that shape a car accident claim

Fault and insurance system

Pennsylvania is a choice no-fault state. Under 75 Pa.C.S. section 1705, drivers choose limited tort or full tort. A limited tort insured can recover medical and other out-of-pocket losses but can't sue for pain and suffering unless the injury is a serious injury or an exception applies. A named insured who doesn't choose is presumed to have chosen full tort.

Comparative fault rule

Pennsylvania uses modified comparative negligence. Under 42 Pa.C.S. section 7102, the plaintiff's negligence doesn't bar recovery if it's not greater than the causal negligence of the defendants, and damages are reduced in proportion.

Deadline to file an injury lawsuit

42 Pa.C.S. section 5524(2) requires an action to recover damages for injuries to the person caused by the negligence of another to be commenced within two years.

Limited tort exceptions

Section 1705(d) lists situations where a limited tort insured keeps full tort rights. They include an at-fault driver who is convicted of, or accepts ARD for, driving under the influence in that accident; an at-fault driver operating a vehicle registered in another state; and an injured person who was an occupant of a vehicle other than a private passenger vehicle.

General information, not legal advice. Confirm current rules with the statute or your counsel.

What this means for Pennsylvania intake

  • Ask whether the caller's own auto policy is limited tort or full tort. Many people don't know, so ask them to check their declarations page.
  • Ask whether the other driver was charged with DUI, or was driving a car registered in another state.
  • Ask for the accident date first. With a two-year filing window, older accidents need a quick review.
  • Ask whether they've already talked to or signed with another lawyer.

Speed matters more than any script. For call openings and follow-up, see our speed-to-lead intake scripts.

What every Pennsylvania car accident lead includes

The injured person fills in our form themselves. Each lead includes:

  • Accident type
  • Date of the accident
  • Location (state and ZIP)
  • Injury status
  • Medical treatment so far
  • Whether they already have an attorney
  • An SMS-verified phone number
  • A TrustedForm certificate

Leads that don't match your filters aren't sent. The TrustedForm certificate records the form session and the consent to be contacted, and the SMS check confirms the phone number. Our TrustedForm and lead verification guide explains how to read both.

How it works for Pennsylvania firms

  1. Book a call. Tell us you're licensed in Pennsylvania, plus any other states, the accident types you take, your intake hours and where leads should go.
  2. Set your Pennsylvania screening and place a first paid order. We agree your filters with you, using questions like the ones above.
  3. We run MVA campaigns nationwide. A lead reaches you only when the accident happened in a state you've chosen and the lead passes your filters.
  4. Leads arrive live in your CRM by webhook, LeadDocket, Litify or GoHighLevel, or by email or SMS alert. See lead routing and CRM delivery.

We don't publish lead volume or ad figures for any single state. The full process is on how it works, and the service is on our MVA leads page.

Frequently asked questions

What are Pennsylvania car accident leads?

How long does an injured person have to sue after a car accident in Pennsylvania?

Pennsylvania's 42 Pa.C.S. section 5524(2) sets two years for personal injury actions, with exceptions. Your attorneys should confirm the deadline for each case.

Does limited tort affect Pennsylvania car accident leads?

It can. Under 75 Pa.C.S. section 1705, a limited tort insured can't recover pain and suffering unless the injury is a serious injury or an exception applies, such as a DUI conviction of the at-fault driver. Ask every Pennsylvania caller which option their policy has.

Can I get car accident leads only from Pennsylvania?

Yes. We generate leads nationwide, and you pick the states where your firm is licensed. If Pennsylvania is your only state, your leads come only from Pennsylvania. We don't promise a set number of leads for any state, and we'll talk through what your filters can support on the call.

What happens if a Pennsylvania lead is unqualified?

We replace it under our written replacement policy, agreed before your first paid order.
