Massachusetts fault, insurance and deadline rules
How Massachusetts auto insurance works
Massachusetts is one of the 12 no-fault states listed by the Insurance Information Institute. Under M.G.L. c. 231, section 6D, a plaintiff in a motor vehicle injury case can recover damages for pain and suffering only if reasonable and necessary medical expenses are over two thousand dollars, or the injury causes death, the loss of a body member, permanent and serious disfigurement, certain loss of sight or hearing, or a fracture.
Minimum liability coverage
For policies issued or renewed on or after July 1, 2025, M.G.L. c. 90, section 34A requires bodily injury liability coverage of at least $25,000 per person and $50,000 per accident, plus personal injury protection of at least $8,000.
Fault and recovery
Massachusetts uses modified comparative negligence. Under M.G.L. c. 231, section 85, the plaintiff's negligence doesn't bar recovery if it wasn't greater than the total negligence of the persons against whom recovery is sought. Damages are reduced in proportion to the plaintiff's negligence.
Time limit to sue
M.G.L. c. 260, section 2A sets three years after the cause of action accrues for actions of tort, except as otherwise provided.
Statutes change, so treat this as general information and confirm with the source.
Massachusetts intake checklist
- Ask about medical treatment and bills so far. Pain and suffering damages in Massachusetts depend on medical expenses over the section 6D threshold or a listed injury.
- Ask whether there's a fracture, scarring or lasting injury, since a listed injury such as a fracture can meet the threshold on its own.
- Confirm the date of the collision early in the call. M.G.L. c. 260, section 2A gives three years, and an attorney should check anything approaching it.
- Ask which insurers are involved, theirs and the other driver's. Massachusetts's required minimum is $25,000 per person for bodily injury, so in a serious injury case ask about the caller's own coverage too.
- Ask what the caller was riding or driving. Motorcyclists were 19% of Massachusetts's 2024 crash deaths, so decide up front whether motorcycle callers fit your intake.
- Ask, without judgment, whether everyone in the vehicle was belted. 52% of occupants killed in Massachusetts in 2024 were unrestrained, so record the answer plainly for the attorney.
