Figures come from the Insurance Institute for Highway Safety's state-by-state fatality table (FARS data); the national comparisons add up all 51 rows.

Michigan rules that shape a car accident claim

Insurance system in Michigan

Michigan is one of the 12 no-fault states listed by the Insurance Information Institute, with a verbal threshold. Under MCL 500.3135, a person stays liable in tort for noneconomic loss only if the injured person has suffered death, serious impairment of body function or permanent serious disfigurement. The statute defines serious impairment of body function, starting with an impairment that is objectively manifested.

Personal protection insurance (PIP) benefits have their own clock. Under MCL 500.3145, an action for PIP benefits can't be started more than 1 year after the accident unless written notice of injury was given to the insurer within that year or the insurer already made a PIP payment.

Minimum liability coverage

After July 1, 2020, MCL 500.3009 requires liability coverage of at least $250,000 for bodily injury to or death of one person and $500,000 per accident, plus $10,000 for property damage, subject to the exceptions in subsections (5) to (8) of that section.

Comparative fault rule

Under MCL 600.2959, damages are reduced by the injured person's percentage of fault, and a claimant who is more than 50% at fault can't recover noneconomic damages.

Deadline to file an injury lawsuit

MCL 600.5805 sets three years for injury to a person, under subsection (2).

This isn't legal advice; check the linked statutes before relying on them.

Questions to ask Michigan callers

  • Ask about the injury itself: diagnosis, treatment and how it affects daily life. Michigan's tort threshold depends on serious impairment of body function or permanent serious disfigurement.
  • Ask whether the caller has given written notice to their own auto insurer and whether any PIP benefits have been paid, since the PIP action has a one-year rule.
  • Ask for the accident date and note it for both clocks: one year for PIP actions and three years for the injury lawsuit.
  • Get both insurance carriers' names if the caller has them. A policy at Michigan's $250,000 per person minimum may not cover a serious injury, which makes the caller's own policy worth asking about.
  • Ask what the caller was riding or driving. Motorcyclists were 17% of Michigan's 2024 crash deaths, so decide up front whether motorcycle callers fit your intake.
