Utah rules that shape a car accident claim
Insurance system in Utah
Utah is one of the 12 no-fault states listed by the Insurance Information Institute. Under Utah Code 31A-22-309(1), a person who has or must have PIP can sue for general damages only for death, dismemberment, permanent disability or impairment based on objective findings, permanent disfigurement, a bone fracture, or medical expenses over $3,000.
PIP itself is set by Utah Code 31A-22-307: at least $3,000 per person for medical expenses, plus lost income up to the lesser of $250 a week or 85 percent of gross income for up to 52 weeks.
Minimum liability coverage
For policies issued or renewed on or after January 1, 2025, Utah Code 31A-22-304 sets liability minimums of $30,000 for bodily injury to or death of one person, $65,000 for two or more people and $25,000 for property damage, or a $90,000 single limit.
Comparative fault rule
Utah uses modified comparative fault. Under Utah Code 78B-5-818, a person seeking recovery can recover from defendants whose combined fault exceeds the claimant's own.
Deadline to file an injury lawsuit
Utah's limitations chapter has no separate personal injury section; Utah Code 78B-2-307 allows four years for relief not otherwise provided for by law, and four years for motor vehicle property damage claims.

Questions to ask Utah callers
- Ask about medical bills so far and whether there's a fracture or a permanent injury. A claim for general damages needs one of the injuries listed in 31A-22-309 or medical expenses over $3,000.
- Ask whether the claim is against an uninsured driver. The tort threshold in 31A-22-309 doesn't apply to an uninsured motorist claim.
- Get the crash date on every call and count forward four years, the period in Utah Code 78B-2-307. Files close to that line go to an attorney the same day.
- Ask which insurers are involved, theirs and the other driver's. Utah's required minimum is $30,000 per person for bodily injury, so in a serious injury case ask about the caller's own coverage too.
- Ask what the caller was riding or driving. Motorcyclists were 19% of Utah's 2024 crash deaths, so decide up front whether motorcycle callers fit your intake.
- Ask for the county and road where the crash happened. 49% of Utah's 2024 deaths were on rural roads, so note the exact location for the police report request.
