Virginia rules that shape a car accident claim

Insurance system in Virginia

Virginia isn't one of the 12 no-fault states listed by the Insurance Information Institute, so injury claims run through the at-fault driver's liability insurance.

Minimum liability coverage

For policies effective on or after January 1, 2025, Va. Code 46.2-472 requires $50,000 for bodily injury to or death of one person, $100,000 for two or more people and $25,000 for property damage.

Comparative fault rule

Virginia still follows contributory negligence. In a 1997 opinion (Record No. 961140), the Supreme Court of Virginia described the Commonwealth's substantive law as recognizing contributory negligence as a complete bar to recovery. That makes the caller's own account of the crash especially important.

Deadline to file an injury lawsuit

Va. Code 8.01-243(A) sets two years after the cause of action accrues for actions for personal injuries, unless otherwise provided.

Questions to ask Virginia callers

  • Fault is the first screen in Virginia. Get the caller's account of how the crash happened, in their words, and note anything they say about their own driving.
  • Ask whether there was a police report and what it said about each driver, if they know.
  • Get the crash date on every call and count forward two years, the period in Va. Code 8.01-243(A). Files close to that line go to an attorney the same day.
  • Ask whether the other driver's insurer has been in touch, and note whether the caller carries underinsured coverage; Virginia requires only $50,000 per person in bodily injury liability.
  • Ask, without judgment, whether everyone in the vehicle was belted. 53% of occupants killed in Virginia in 2024 were unrestrained, so record the answer plainly for the attorney.
  • Ask for the county and road where the crash happened. 50% of Virginia's 2024 deaths were on rural roads, so note the exact location for the police report request.
