Who handles District of Columbia workers' comp claims
DC claims and notices go to the Mayor, through the Department of Employment Services, as well as the employer. Under D.C. Code 32-1514(b), a late claim isn't barred unless the objection is raised at the first hearing.
District of Columbia notice and filing rules
Written notice within 30 days
D.C. Code 32-1513 requires written notice to the Mayor and the employer within 30 days after the injury, or 30 days after the worker knew or should have known of its link to work. Late notice doesn't bar the claim if the employer or carrier knew and wasn't prejudiced, or the failure is excused.
Claim within one year
Under 32-1514(a), a claim must be filed within one year after the injury, or within one year of the last payment if compensation was paid without an award. The clock doesn't start until the worker is aware, or should have been, of the link between the injury and the job.
Rules change; the DC Department of Employment Services' Office of Workers' Compensation has the current versions.
What to ask a District of Columbia injured worker
- When was the injury, and when did you notify your employer in writing?
- When did you first connect the injury to your work?
