Alabama rules that shape a car accident claim

Insurance system in Alabama

Alabama isn't one of the 12 no-fault states listed by the Insurance Information Institute, so injury claims run through the at-fault driver's liability insurance.

Minimum liability coverage

Under Ala. Code 32-7-6, a qualifying policy carries limits of at least $25,000 for bodily injury to or death of one person in any one accident, $50,000 for two or more people and $25,000 for property damage.

Comparative fault rule

Alabama still follows contributory negligence. In Williams v. Delta Int'l Machinery Corp. (1993), the Supreme Court of Alabama declined to abolish the doctrine, so a plaintiff's own negligence that contributed to the injury can bar recovery.

Deadline to file an injury lawsuit

Ala. Code 6-2-38(l) requires actions for injury to the person or rights of another, not arising from contract and not otherwise listed, to be brought within two years.

This isn't legal advice; check the linked statutes before relying on them.

Questions to ask Alabama callers

  • Fault decides most Alabama files early. Get the caller's own account of the crash and note anything that suggests they contributed to it, such as a citation they received.
  • Ask whether the caller was a passenger, a driver or on foot. Passengers who didn't contribute to the crash are often simpler to screen under a contributory negligence rule.
  • Get the crash date on every call and count forward two years, the period in Ala. Code 6-2-38(l). Files close to that line go to an attorney the same day.
  • Ask which insurers are involved, theirs and the other driver's. Alabama's required minimum is $25,000 per person for bodily injury, so in a serious injury case ask about the caller's own coverage too.
  • Ask for the county and road where the crash happened. 59% of Alabama's 2024 deaths were on rural roads, so note the exact location for the police report request.
  • Ask, without judgment, whether everyone in the vehicle was belted. 54% of occupants killed in Alabama in 2024 were unrestrained, so record the answer plainly for the attorney.
