Wyoming rules that shape a car accident claim
Insurance system in Wyoming
Wyoming isn't one of the 12 no-fault states listed by the Insurance Information Institute, so injury claims run through the at-fault driver's liability insurance.
Minimum liability coverage
W.S. 31-9-405 defines a liability policy as one with limits of at least $25,000 for bodily injury to or death of one person, $50,000 for two or more people and $20,000 for property damage in one accident.
Comparative fault rule
Wyoming uses modified comparative fault. Under Wyo. Stat. 1-1-109, the claimant's fault doesn't bar recovery if it is not more than 50 percent of the total fault of all actors; damages are reduced in proportion, the jury is told the effect of its percentages, and each defendant is liable only for its own share.
Deadline to file an injury lawsuit
Under Wyo. Stat. 1-3-105(a)(iv)(C), an action for an injury to the rights of the plaintiff not arising on contract and not otherwise listed must be brought within four years after the cause of action accrues, which covers injury claims from a crash.
This isn't legal advice; check the linked statutes before relying on them.
Questions to ask Wyoming callers
- Ask about every driver and party involved. Under 1-1-109, fault is compared with all actors, and each defendant pays only its own share.
- Ask whether the other driver had insurance. Under W.S. 31-4-103, drivers must keep coverage, but an uninsured driver changes where recovery comes from.
- Get the crash date on every call and count forward four years, the period in Wyo. Stat. 1-3-105. Files close to that line go to an attorney the same day.
- Get both insurance carriers' names if the caller has them. A policy at Wyoming's $25,000 per person minimum may not cover a serious injury, which makes the caller's own policy worth asking about.
- Ask for the county and road where the crash happened. 75% of Wyoming's 2024 deaths were on rural roads, so note the exact location for the police report request.
- Ask, without judgment, whether everyone in the vehicle was belted. 61% of occupants killed in Wyoming in 2024 were unrestrained, so record the answer plainly for the attorney.
