Oregon rules that shape a car accident claim

Insurance system in Oregon

Oregon isn't one of the 12 no-fault states listed by the Insurance Information Institute, so injury claims run through the at-fault driver's liability insurance.

Oregon still requires personal injury protection on auto policies. Under ORS 742.524, PIP pays reasonable and necessary medical expenses incurred within two years of the injury, up to $15,000 for bodily injury expenses per person, plus 70 percent of lost income (capped at $3,000 a month for up to 52 weeks) when disability lasts at least 14 days.

Minimum liability coverage

ORS 806.070 sets the minimum payment schedule at $25,000 for bodily injury to or death of one person in any one accident, $50,000 for two or more people and $20,000 for property damage.

Comparative fault rule

Oregon uses modified comparative negligence. Under ORS 31.600, a claimant's fault doesn't bar recovery if it isn't greater than the combined fault of all the other persons the statute compares; damages are reduced by the claimant's percentage.

Deadline to file an injury lawsuit

ORS 12.110(1) sets two years for any injury to the person or rights of another not arising on contract.

Questions to ask Oregon callers

  • Ask whether the caller's PIP claim is open and what medical bills it has paid. PIP covers expenses incurred within two years of the injury, so the treatment timeline matters.
  • Ask how long the caller was off work. PIP income benefits under ORS 742.524 start only when disability lasts at least 14 days.
  • Get the crash date on every call and count forward two years, the period in ORS 12.110. Files close to that line go to an attorney the same day.
  • Get both insurance carriers' names if the caller has them. A policy at Oregon's $25,000 per person minimum may not cover a serious injury, which makes the caller's own policy worth asking about.
  • Ask for the county and road where the crash happened. 54% of Oregon's 2024 deaths were on rural roads, so note the exact location for the police report request.
  • Ask whether the police report or witnesses mention speed; speeding was a factor in 30% of Oregon's 2024 crash deaths.
