Who handles Idaho workers' comp claims

Idaho disputes are heard by the Industrial Commission. Under Idaho Code 72-706, a claimant files an application requesting a hearing with the commission, and relief is forever barred if it isn't filed on time.

Idaho notice and filing rules

Notice within 60 days, claim within a year

Idaho Code 72-701 requires notice of the accident to the employer as soon as practicable, and no later than 60 days, and a claim for compensation within one year after the accident. A claim isn't required if compensation was paid voluntarily or a hearing application was filed.

Hearing deadlines

Under 72-706, if a claim was made and nothing was paid, the claimant has one year from the claim to apply for a hearing. If payments started and then stopped, the limit is five years from the accident, or one year from the last income benefit if benefits stopped more than four years after it.

Rules change; the Idaho Industrial Commission has the current versions.

What to ask a Idaho injured worker

  • When did the accident happen, and when did you tell your employer?
  • Has a claim been made, or has any compensation been paid?
  • If payments stopped, when was the last one?
  • Has an application for hearing been filed with the Industrial Commission?
