Who handles Indiana workers' comp claims

Indiana's system is run by the Worker's Compensation Board of Indiana. Under Ind. Code 22-3-3-3, a claim for compensation is filed with the board.

Indiana notice and filing rules

Written notice to the employer

Under Ind. Code 22-3-3-1, the injured employee should give written notice to the employer as soon as practicable after the injury. Unless notice is given or the employer knows of the injury within 30 days, no compensation is paid until notice is given. Lack of notice doesn't bar compensation unless the employer shows it was prejudiced.

Filing the claim

Under Ind. Code 22-3-3-3, the right to compensation is forever barred unless a claim is filed with the board within two years after the accident, or after death. If temporary total or temporary partial disability benefits were paid, the two years run from the last payment date.
