Who handles Louisiana workers' comp claims

Louisiana claims go to the Office of Workers' Compensation. Under La. R.S. 23:1209(B), a claim can be filed with the office by delivery or by mail, and a mailed claim counts as timely if it's mailed on or before the prescription date.

Louisiana notice and filing rules

Notice to the employer

Under La. R.S. 23:1301, no proceeding for compensation can be maintained unless the employer gets notice of the injury within 30 days. Section 23:1303 says the notice is written, names the employee and their address, states the time, place, nature and cause of the injury and is signed. If the employer failed to keep the required notice posted, section 23:1302(B) extends the time to 12 months.

Filing the claim

Under La. R.S. 23:1209(A), a claim is barred unless, within one year after the accident, the parties agree on payments or a formal claim is filed. If payments were made, the year runs from the last payment. When the injury develops later, the year runs from when it develops, but the claim must start within three years of the accident. Under 23:1209(C), medical benefit claims run three years from the last medical payment when payments were made.
