Who handles Kentucky workers' comp claims

Kentucky claims run through the Department of Workers' Claims. When the parties can't agree on compensation, KRS 342.270 lets either side file a written application for resolution of claim. The commissioner assigns it to an administrative law judge, and the employer or carrier has 45 days after the notice of filing to accept or deny the claim.

Kentucky notice and filing rules

Notice and the two-year limit

Under KRS 342.185, notice of the accident goes to the employer as soon as practicable, and an application for adjustment of claim must be filed with the department within two years after the accident. If income benefits were paid, the deadline becomes two years after the payments stop or two years after the accident, whichever is later.

Cumulative trauma

For a cumulative trauma injury, KRS 342.185 runs both notice and the application from the date a physician tells the employee the injury is work-related, two years in each case, with a five-year outer limit after the last injurious exposure.

Join every known claim

KRS 342.270 requires an employee who files to join all known causes of action against the named employer; claims left out are treated as waived.

  • Is this a repetitive or cumulative injury? When did a doctor first say it was work-related?
  • Are there other injuries with the same employer that haven't been claimed yet?
