Who handles Utah workers' comp claims

Utah claims run through the Labor Commission. A disputed claim for disability compensation starts with an application for hearing filed with the commission's Division of Adjudication under Utah Code 34A-2-417.

Utah notice and filing rules

Notice within 180 days

Under Utah Code 34A-2-407, the employee must promptly notify the employer, and a claim is barred if neither the employer nor the division is notified within 180 days after the injury. An employer's report, a physician's injury report or payment of medical or disability benefits also counts as notice.

Six years to apply, twelve to prove

34A-2-417 bars disability claims unless the employee files an application for hearing within six years of the accident and can prove the compensation due within 12 years. Medical expenses must be submitted to the employer or carrier within one year of when they're incurred or known to be work-related, and death claims need an application within one year of the death.
