The Vermont workers' comp system
Vermont claims are handled by the Department of Labor's Workers' Compensation Division. Under 21 V.S.A. 660, proceedings to start a claim can't be commenced after three years from the date of injury, and two years from when an occupational disease is reasonably discoverable.
Deadlines a Vermont worker has to meet
Notice as soon as practicable
21 V.S.A. 656 requires notice of the injury to the employer as soon as practicable. Under 660, missing or late notice isn't a bar if the employer knew of the accident or wasn't prejudiced by the delay.
Claim within six months
Under 656, the claim for compensation is due within six months after the injury, measured from when the injury and its relation to work were reasonably discoverable. No claim is needed if the employer paid voluntarily, but after a denial of those payments, proceedings must start within six months of the denial.
