Nevada rules that shape a car accident claim
Insurance system in Nevada
Nevada isn't one of the 12 no-fault states listed by the Insurance Information Institute, so injury claims run through the at-fault driver's liability insurance.
Minimum liability coverage
NRS 485.185 requires coverage of at least $25,000 for bodily injury to or death of one person in any one accident, $50,000 for two or more people and $20,000 for property damage.
Comparative fault rule
Nevada uses modified comparative negligence. Under NRS 41.141, a plaintiff's negligence doesn't bar recovery if it isn't greater than the negligence of the parties against whom recovery is sought; damages are reduced by the plaintiff's share, and each defendant is generally liable only for its own share.
Deadline to file an injury lawsuit
NRS 11.190(4)(e) sets two years for an action for injuries to or death of a person caused by the wrongful act or neglect of another.
This isn't legal advice; check the linked statutes before relying on them.
Questions to ask Nevada callers
- Ask how many drivers or companies may share the blame. Under NRS 41.141, each defendant is generally liable only for its own percentage of fault, so the number of defendants affects the recovery.
- Get the crash date on every call and count forward two years, the period in NRS 11.190(4)(e). Files close to that line go to an attorney the same day.
- Ask whether the other driver's insurer has been in touch, and note whether the caller carries underinsured coverage; Nevada requires only $25,000 per person in bodily injury liability.
- Ask whether the caller was walking or standing near the road when hit; pedestrians made up 26% of Nevada crash deaths in 2024. Route those to your pedestrian accident screen.
- Ask what the caller was riding or driving. Motorcyclists were 21% of Nevada's 2024 crash deaths, so decide up front whether motorcycle callers fit your intake.
