New Hampshire fault, insurance and deadline rules
How New Hampshire auto insurance works
New Hampshire isn't one of the 12 no-fault states listed by the Insurance Information Institute, so injury claims run through the at-fault driver's liability insurance.
Minimum liability coverage
RSA 259:61 defines a motor vehicle liability policy as one with limits of at least $25,000 for bodily injury to or death of one person, $50,000 for two or more people and $25,000 for property damage.
Fault and recovery
New Hampshire uses modified comparative fault. Under RSA 507:7-d, a plaintiff's fault doesn't bar recovery if it was not greater than the fault of the defendant, or the defendants together; damages are reduced by the plaintiff's share, and the party alleging fault has to prove it.
Time limit to sue
RSA 508:4 allows personal actions within three years of the act or omission. If the injury and its cause couldn't reasonably have been discovered then, the three years run from when they were, or should have been, discovered.
Statutes change, so treat this as general information and confirm with the source.
New Hampshire intake checklist
- Ask how the other driver's insurer describes fault. Under RSA 507:7-d, the defendant has to prove the caller's fault, and a caller less at fault than the defendants together can still recover.
- Confirm the date of the collision early in the call. RSA 508:4 gives three years, and an attorney should check anything approaching it.
- Ask whether the other driver's insurer has been in touch, and note whether the caller carries underinsured coverage; New Hampshire requires only $25,000 per person in bodily injury liability.
- Ask what the caller was riding or driving. Motorcyclists were 26% of New Hampshire's 2024 crash deaths, so decide up front whether motorcycle callers fit your intake.
- Ask for the county and road where the crash happened. 56% of New Hampshire's 2024 deaths were on rural roads, so note the exact location for the police report request.
