Wyoming's agency and claim process
Wyoming is a monopolistic state: injury claims go to the Workers' Compensation Division, the state fund, not a private insurer. Under W.S. 27-14-502, the worker must also file an injury report with the employer and the division within 10 days after the injury's general nature became apparent.
Wyoming timing rules for intake
Tell the employer within 72 hours
Under W.S. 27-14-502(a), the worker must report the injury's occurrence and general nature to the employer as soon as practical, and no later than 72 hours after it became apparent. Under 502(c), a failure creates a presumption that the claim will be denied, which the worker can overcome only with clear and convincing evidence that no one was prejudiced.
Claim within one year
W.S. 27-14-503 bars a claim not filed within one year after the injury, or after discovery for an injury not readily apparent; the injury report doesn't count as the claim. For injuries over time, the limit is one year after the diagnosis is communicated or three years from the last injurious exposure, whichever is later.
Not legal advice. Check current rules with the Wyoming Workers' Compensation Division before relying on them.
