The Alaska workers' comp system
Alaska claims are filed with the Division of Workers' Compensation and decided by the Alaska Workers' Compensation Board. Under AS 23.30.110(c), if the employer controverts a claim and the worker doesn't request a hearing within two years of the controversion notice, the claim is denied.
Deadlines a Alaska worker has to meet
Report within 15 days
The Division's guide for injured workers says that from January 1, 2025, a work injury must be reported to the supervisor in writing within 15 days of the event or of discovering it is work-related; the deadline for earlier injuries was 30 days. Under AS 23.30.100, late notice doesn't bar a claim if the employer or carrier knew and wasn't prejudiced, or the Board excuses it.
Claim within two years
AS 23.30.105 bars a disability claim not filed within two years after the worker knows the nature of the disability and its relation to work, with a four-year outside limit except for occupational disease. If compensation was paid without an award, a claim can be filed within two years of the last payment.
