The Alabama workers' comp system

Alabama's workers' comp program is overseen by the Department of Labor's Workers' Compensation Division. When the parties don't agree on compensation, Ala. Code 25-5-80 points to a verified complaint filed as provided in section 25-5-88.

Deadlines a Alabama worker has to meet

Written notice within five days

Under Ala. Code 25-5-78, the injured employee or a representative must give the employer written notice of the accident within five days. Without notice, medical fees and compensation aren't owed unless the worker was prevented by physical or mental incapacity, fraud or deceit, or equal good reason, and no compensation is payable at all unless written notice is given within 90 days after the accident or death.

The two-year limit

Ala. Code 25-5-80 bars a claim unless, within two years after the accident, the parties agree on compensation or one of them files a verified complaint. For injuries from cumulative physical stress, the two years run from the date of injury. If compensation payments, as distinct from medical or vocational payments, were made, the period starts from the last payment.
