This guide is for workers' comp firms licensed in North Dakota: who runs the system, the deadlines an injured worker faces and the questions that sort a North Dakota lead. All states' deadlines are in the workers' comp deadlines by state table.
How workers' comp is run in North Dakota
North Dakota is a monopolistic state: claims go to Workforce Safety and Insurance, the state fund, not a private insurer. Under N.D.C.C. 65-05-01.4, the employer must file a first report with the organization within seven days of receiving notice of the injury.
What to screen for in North Dakota
Notice within 7 days
Under N.D.C.C. 65-05-01.2, the worker must tell an immediate supervisor, orally or in writing, and absent good cause no later than seven days after the accident or after the general nature of the injury became apparent. A failure to notify can count against compensability under 65-05-01.3.
Claim within one year
N.D.C.C. 65-05-01 requires the original claim to be filed within one year after the injury, or two years after a death. The date of injury is when a reasonable person knew or should have known of a work injury that caused lost wages or medical treatment.
