Taking Ohio workers' comp cases? Here's how the Ohio system is set up, what the notice and filing rules say and how to screen callers, with a link to each source. Other states are on the workers' comp leads by state hub.
Who handles Ohio workers' comp claims
Ohio's system is run by the Ohio Bureau of Workers' Compensation (BWC), with disputed claims heard by the Industrial Commission of Ohio. Ohio is one of four states, with North Dakota, Washington and Wyoming, where employers get workers' comp coverage through the state fund rather than private insurers, according to a 2023 Wyoming Legislature memo and North Dakota WSI.
For intake, that means the claim usually runs through BWC rather than a private insurance carrier.
Ohio notice and filing rules
Filing with BWC or the Industrial Commission
Under Ohio Revised Code 4123.84, a claim is forever barred unless, within one year after the injury, written notice of the injury goes to the Industrial Commission or BWC, or one of the section's listed exceptions applies, such as certain payments of compensation or medical bills. The same section lets BWC accept notice by telephone.
Reporting to the employer
We couldn't confirm a statutory day count for reporting to an Ohio employer on an official page in this update, so we don't give one here. Ask when the injury was reported, and let your attorneys check the rule.
Not legal advice. Check current rules with the Ohio Bureau of Workers' Compensation before relying on them.
What to ask a Ohio injured worker
- When did the injury happen, and has a claim been filed with BWC? When?
- Is the employer covered through BWC, or is it a self-insuring employer?
- When did you report the injury to your employer, and how?
