Who handles Oklahoma workers' comp claims
Oklahoma claims fall under the Administrative Workers' Compensation Act in Title 85A. Under 85A O.S. 69, a claim for benefits is filed with the Workers' Compensation Commission, and after filing the employee must request a hearing on any dispute, or receive or seek benefits, within six months, or the employer can move to dismiss the claim with prejudice.
Oklahoma notice and filing rules
Notice to the employer
Under 85A O.S. 68, unless the employee gives oral or written notice within 30 days of the injury, the injury is presumed not to be work-related, a presumption the employee must overcome by a preponderance of the evidence. For occupational disease or cumulative trauma, the 30 days run from separation from employment.
Filing deadlines
85A O.S. 69 bars a claim not filed within one year from the date of injury, or six months from the last benefits issued if benefits were paid. Occupational disease claims have two years from the last injurious exposure, and a latent injury doesn't toll the limits for accidental injuries.
