Public-entity rules seen in Austin files
When the city, Travis County, a school district or a transit agency may be responsible, the Texas Tort Claims Act (CPRC chapter 101) applies, including six-month notice under section 101.101.
- Road work and obstructions. Section 101.022 limits the duty owed for ordinary premise defects, but that limit doesn't apply to the duty to warn of special defects such as excavations or obstructions on roads.
- Emergency vehicles. Section 101.055(2) excludes claims from an employee's response to an emergency call if the action complied with the applicable laws, or, without such a law, wasn't taken with conscious indifference or reckless disregard for others' safety.
- School vehicles. Section 101.051 says the chapter doesn't apply to school districts, except as to motor vehicles, so a school bus crash can still fall within it.
Texas law for Austin claims
Austin crash claims follow Texas's two-year limit (CPRC 16.003) and the 51% bar (CPRC 33.001). Both are sourced on the Texas car accident leads page and in the statute of limitations by state table.

Austin intake checklist
- Ask whether the crash happened in a construction zone, near an excavation or around a lane closure. Note who was working there if the caller knows.
- Ask whether a police car, ambulance or fire truck was involved, and whether it was running lights and siren. Emergency responses have their own rule under CPRC 101.055.
- Ask whether a school bus, a CapMetro bus or another public vehicle was part of the crash, and note the date for the notice period.
- Ask whether the caller was on a bike or scooter or walking. Route them to your bicycle accident or pedestrian accident screen.

TxDOT's 2024 city table shows 98 people killed in crashes in the City of Austin. Travis County recorded 155 deaths in total.
Does the Texas Tort Claims Act cover crashes in road construction zones?
It can. CPRC 101.022 keeps the duty to warn of special defects, such as excavations or obstructions on roads, even though it limits the duty owed for ordinary premise defects. An attorney should review these facts early.

CPRC 101.055(2) excludes claims from an emergency response if the employee followed the applicable laws, or, where none apply, didn't act with conscious indifference or reckless disregard. Other emergency-vehicle crashes may still be covered.
Are school bus crashes covered by the Tort Claims Act?
CPRC 101.051 excludes school districts from the chapter except as to motor vehicles, so a school bus crash can fall within it.
