Tort Claims Act points for San Antonio crashes
Claims against the city, Bexar County or a transit agency fall under CPRC chapter 101. Formal notice is due within six months of the incident under section 101.101(a), and a city charter may set its own period. Two more rules matter:
- Actual notice. Under section 101.101(c), the formal notice requirement doesn't apply if the governmental unit has actual notice that a death occurred, that the claimant was injured or that property was damaged. Whether that applies is a question for an attorney, not intake.
- Traffic signals. Under section 101.060, a claim over the absence, condition or malfunction of a traffic sign or signal is excluded unless the unit failed to correct it within a reasonable time after notice. Crashes at a dark or broken signal need early attention.
Texas law that still governs
San Antonio cases use the Texas two-year limit (CPRC 16.003) and the proportionate responsibility rule that bars recovery above 50% (CPRC 33.001). Sources are on the Texas car accident leads page and in the statute of limitations by state table.

Questions for San Antonio callers
- Ask whether the other driver was on a phone or otherwise distracted, and whether police noted it. Distracted-driver crashes killed 58 people in Bexar County in 2024.
- Ask whether the signal at the intersection was working. A dark or damaged signal can raise a claim against the city, with its own conditions under CPRC 101.060.
- Ask whether a VIA bus or a city or county vehicle was involved, and when the crash happened, so an attorney can check the notice period.
- Ask whether the crash was inside San Antonio city limits or elsewhere in Bexar County. It decides which agency took the report.
