Suing a Florida public body after a Tampa crash
Crashes involving a HART bus, a city or county vehicle, or a state road crew fall under Fla. Stat. 768.28. After the written claim under section 768.28(6), two more rules apply:
- Suit deadline. Under section 768.28(14), the civil action must be filed within 4 years after the claim accrues, except that wrongful death and medical malpractice follow the limits in section 95.11(5).
- Who to name. Under section 768.28(9)(a), a government officer, employee or agent isn't personally liable for acts within the scope of employment unless they acted in bad faith, with malicious purpose or with wanton and willful disregard of safety. The claim generally runs against the entity.
Statewide rules that still apply
Tampa crash claims against private drivers follow Florida's PIP and 14-day rule, the two-year limit in Fla. Stat. 95.11(5)(a) and the more-than-50-percent fault bar. Sources are on the Florida car accident leads page and in the statute of limitations by state table.
General information, not legal advice. Confirm current rules with the statute or your counsel.
What to ask Tampa callers
- Ask whether the caller was on a bicycle or on foot. Bicycle crashes in Hillsborough rose to 687 in 2024; route these to your bicycle accident or pedestrian accident screen.
- Ask whether the other driver was arrested, tested or suspected of drinking or drug use, and whether the caller has the report number.
- Ask whether a HART bus, a city or county vehicle or a road crew was involved, so an attorney can plan the written claim and choose the right defendant.
- Ask for the date of the crash and the date of first treatment. Both drive Florida deadlines.
