Claims against Orange County, Orlando or LYNX

When a county, city or transit vehicle causes the crash, Fla. Stat. 768.28 sets the terms:

  • Damage limits. Under section 768.28(5)(a), the state and its agencies and subdivisions don't pay a claim or judgment by any one person above $200,000, or above $300,000 for all claims from the same incident. Amounts above that can be reported to the Legislature.
  • Waiting period. Under section 768.28(6)(d), if the agency doesn't make a final disposition within 6 months after the written claim is filed, that counts as a final denial.

The written claim itself is due within 3 years under section 768.28(6)(a).

Florida law behind Orlando claims

Orlando files run on statewide rules: PIP with its 14-day treatment rule, the two-year negligence limit and the more-than-50-percent fault bar. See the Florida car accident leads page and the statute of limitations by state table for sources.

General information, not legal advice. Confirm current rules with the statute or your counsel.

Orlando intake questions

  • Ask whether a tour bus, rental vehicle, delivery truck or other commercial vehicle was involved. Commercial vehicles were part of 2,828 Orange County crashes in 2024; route trucks to your truck accident screen.
  • Ask whether a LYNX bus or a county or city vehicle was involved, and record the crash date so an attorney can plan the written claim.
  • Ask whether the other driver was arrested or suspected of impairment.
  • Ask whether the caller lives in Florida or was visiting. It affects which auto policies and PIP coverage apply.
