Miami-Dade County's 2024 crash record

The Florida Department of Highway Safety and Motor Vehicles' 2024 Traffic Crash Facts Annual Report lists 60,000 crashes in Miami-Dade County in 2024, with 272 people killed and 29,359 injured. Deaths were down from 325 in 2023 and 309 in 2022.

Claims against Miami-Dade County or a city

Florida waives sovereign immunity for torts only within the limits of Fla. Stat. 768.28. Under section 768.28(6)(a), no action may be filed unless the claimant first presents the claim in writing to the agency within 3 years after the claim accrues, and the claim is then denied. Claims against a municipality or county don't also go to the Department of Financial Services; claims against state agencies do.

Wrongful death claims are different: the written claim must reach the Department of Financial Services within 2 years.

Florida rules that apply in Miami

Miami claims follow state law, including PIP and the 14-day treatment rule, the two-year negligence limit in Fla. Stat. 95.11(5)(a) and the bar on recovery for a claimant more than 50 percent at fault. All are sourced on the Florida car accident leads page and in the statute of limitations by state table.

General information, not legal advice. Confirm current rules with the statute or your counsel.

Questions for Miami callers

  • Ask whether the caller was walking, on a motorcycle or on a bike. Pedestrians and motorcyclists together accounted for 142 of Miami-Dade's 272 deaths in 2024. Use your pedestrian accident and motorcycle accident screens.
  • Ask whether a Metrobus, a county vehicle or a city vehicle was involved. Those claims need a written claim to the agency before any suit.
  • Ask whether a truck or delivery van was involved, and note the company if known.
  • Ask when they first saw a doctor. The PIP 14-day rule applies across Florida.
