Claims against the City of Dallas
A crash caused by a city employee driving a city vehicle falls under the Texas Tort Claims Act. Two parts of CPRC chapter 101 shape these files:
- Damage limits. Under section 101.023(c), a municipality's liability is capped at $250,000 for each person and $500,000 for each single occurrence for bodily injury or death. Other local units, such as counties, are capped at $100,000 and $300,000 under section 101.023(b).
- Who to sue. Under section 101.106, filing suit against the governmental unit bars a suit against the individual employee over the same subject matter, and the reverse also applies. Naming the right defendant early matters.
Notice is also due within six months under section 101.101, and a city charter can set its own period.
State law for Dallas crash claims
Dallas files follow Texas's two-year limit in CPRC 16.003 and the bar on recovery above 50% responsibility in CPRC 33.001, both covered on the Texas car accident leads page and in the statute of limitations by state table.

Intake questions for Dallas calls
- Ask which city and county the crash happened in. Dallas spans more than one county, and the answer decides the court and the crash data that apply.
- Ask whether the other driver was in a city, county or DART vehicle. Flag it for an attorney, because the damage cap and the choice of defendant differ for public entities.
- Ask whether a commercial truck was involved and send those to your truck accident screen.
- Ask whether the caller has the police report number. Dallas-area crashes can be worked by city police, the sheriff or DPS.
